A couple of questions you need to ask yourself are: Is the damage over $1000 and/or is there an injury? If those apply….then yes. If it is under $1000 and on private property….then no.
No - the call goes through Shawnee County dispatch.
It shall be unlawful for any minor under 18 years of age to loiter, idle, wander, stroll, play in or be upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places, public buildings, or places of amusement or entertainment, or vacant lots or other unsupervised places within the city between the hours of 12:00 midnight and 6:00 a.m. the following day. The provisions of this section shall not apply to such minors when accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or when a minor is upon an emergency errand or lawful duty or employment directed by his or her parent, guardian, or other adult having the care and custody of the minor, or when attending school functions and other activities under the supervision of school authorities or organizations sponsored by parent and be upon the streets of the city while returning home from any such function or activity. (Ord. 553, Sec. 1)

The Child Passenger Safety Act
(KSA 8-1343) is a primary law.

REQUIREMENTS :

  • All children under age four must be in an appropriate federally-approved child safety seat.
  • Children four years of age, but under the age of eight years must be in an appropriate federally-approved child safety seat/booster seat UNLESS the child weighs more than 80 pounds OR is taller than 4'9" in height.
  • Children eight years of age but under the age of 14 must be protected by a safety belt.

APPLIES TO :

  • All drivers transporting children
  • All passenger vehicles designed for carrying 10 passengers or fewer
  • Kansas residents and non-residents alike
  • All seating positions in vehicle

DOES NOT APPLY TO:

  • Vehicles on a truck chassis registered for more than 12,000 pounds
  • Farm trucks registered for more than 16,000 pounds

OTHER PROVISIONS :

  • Drivers may be stopped solely for a violation of this law.
    • Only drivers may be cited for violations. The fine is $60, but will be waived if the driver provides proof of purchase or acquisition of the appropriate child passenger safety seat(s).
    • There is no violation if the number of children being transported exceeds the number of securing locations and all securing locations are in use by children.
    • Only a single violation exists even when more than one child in a vehicle is not properly restrained.
    • Convictions are not considered moving violations.
    • Persons under the age of 14 are prohibited from riding in any portion of the vehicle not intended for passengers, this includes riding in the back of pickup trucks (KSA 8-1578a).

The Kansas Safety Belt Use Act (KSA 8-2501) applies to occupants age 14 and older.

If under age 16, may drive at any time:

  • To/from or in connection with any job, employment or farm-related work
  • Over the most direct and accessible route between home and school for the purpose of attendance
  • When accompanied by an adult* in front seat who holds a valid driver’s license
  • During this time:
    • Must complete additional 25 hours of supervised driving (10 of the 50 hours total must be at night)
    • NO non-sibling minor passengers are allowed
    • NO wireless communication device while driving except to report illegal activity or to summon emergency help

If over age 16, first 6 months, may drive at any time:

  • From 5 a.m. to 9 p.m.
  • To/from or in connection with any job, employment or farm-related work
  • To/from authorized school activities or religious worship service held by a religious organization
  • When accompanied by an adult* in front seat who holds a valid driver’s license
  • During this time:
    • One non-immediate family member minor passenger (less than 18 years old) is allowed
    • NO wireless communication device while driving except to report illegal activity or to summon emergency help
    • * at least age 21
